Important terms and conditions to know before purchasing your course/s

Enrollment to any course offered by Madame Mak Jewellery/Madame Mak Wax Academy indicates a student's inherent acceptance of these "Terms and Conditions" and forms a binding agreement between you (the "student") and Madame Mak Jewellery/Madame Mak Wax Academy. Please read the Terms and Conditions carefully.

Course Access, Duration, General Rules Of Engagement and Refunds

1. Please provide your full details at the checkout so Madame Mak can reach you if required. Your personal details are not shared with any third party. You herein grant permission for Madame Mak to contact you via any of your provided details at the checkout in the event it is required.

2. Students who purchase a course are required to immediately complete account setup after checkout, so they can easily access their purchased course/s. Failure to do so may lead to a delay in course access until your situation is rectified. Any such delay will not be compensated.

3. Each online course has a duration of two (2) years, unless specified otherwise in the product listing. Your access commences from your day of purchase, and expires two (2) years from your purchase date (not from your "first login" date). During this two year period, you are granted 24/7 access to log in at any time. For example, if you purchase the wax academy course only, your access expires two years from the date of purchase. If you purchase the full bundle/discount (wax, plus metals and gems), your access expires two years from the date of purchase (not four)! If you purchase a course and don't log in for 6 months, your course shall expire 1.5 years from your first login (the time lapse is inclusive of the time delay between the date of purchase and the first login date). The course content is fully accessible from the first login (sections are not drip fed or delayed).

4. Students are not entitled to retrospective reimbursement if two courses are purchased independently of each other at separate times. Students interested in the full course are encouraged to purchase the course bundle (wax & metals & gems) in the first instance to claim the bundle discount offer. 

5. Students are not entitled to claim partial refunds or reimbursement in the event any of their previously purchased courses are offered in the future at a discounted price or a sale.

6. This course is strictly provided in English only, with closed captions in English accessible for each video. Shall captions in English not be available or accessible, please contact Madame Mak Jewellery for rectification. The captions will not be delivered (translated/captioned/uploaded) in any other language at any stage.

7. Students acknowledge that the course content may be modified (added or removed) during the provision of the course. Students are responsible for finding the new materials (which will be labelled as "NEW", with the date of upload once uploaded by Madame Mak Jewellery, and announced via the channels in the course/s).

8. Students acknowledge that some videos and documents in the course may contain typographical errors. Madame Mak has made every effort during post-production to ensure transcription and spelling accuracy, however the occasional glitch may have passed through into the final edits. Minor edits will not be rectified, however if a student discovers a major issue please contact Dahna immediately.

9. Once a course has expired, access can not be extended or renewed by Madame Mak Jewellery.

10. Students will have access to the discussion boards for the duration of the course they have enrolled in. Once your course has expired, you will lose access to the discussion boards and learning materials. Madame Mak will be contributing to and monitoring the discussion boards, so please submit your questions in the discussion or comments section beneath the videos and expect a response from Dahna.

11. Enrolled students agree to submit all questions and queries regarding course content via the discussion thread and via the comments section beneath each video, for all members to see. Please refrain from contacting Dahna privately about general questions. Your question (and my answer) might help others in the forum too!

12. Madame Mak will not send PDF learning materials to you after your course has expired. Madame Mak kindly requests you download all available materials at your earliest convenience if necessary. Videos can not be downloaded by students.

13. Your course login (username and password) is accessible via the Podia login portal and is your unique personal login. Your login credentials are strictly not to be shared with others. It is your responsibility to keep a record of your login and password, and to change your password as required (eg. forgotten password) by using the relevant prompts during login.

14. Students acknowledge that some video files in the course are large and require a decent internet connection/speed to properly load. Madame Mak assumes no responsibility for the quality of your connectivity/internet connection and will not offer refunds for poor internet connection. Video files can not be downloaded due to their large size.

15. Students acknowledge that the website host (Podia) may encounter glitches or downtime, which affects login and/or access and usability. Madame Mak is not responsible for any downtime incurred by Podia, and students are unable to claim damages for any lost time due to technical outages.

16. Students will not be refunded if they are dissatisfied with any component of the online course/s, except for any instance of gross misrepresentation of the course's content. For any questions or concerns, please contact Madame Mak Jewellery to discuss directly. Due to the significant intellectual property, time and goodwill invested into the creation of this jewellery course, students are not eligible for refunds once they have logged in to their student portal. Please read the course agendas carefully before purchasing, and contact Dahna with any questions before making the commitment to purchase!

17. Students will not be refunded for accidental purchases, buyers regret or change of mind. Please check the itemised class topics before purchasing a course and contact Madame Mak jewellery with any questions before signing up to any given course. By purchasing a course you agree you have read the itemised course agenda and that you understand what is and isn't included prior to the checkout.

18. Students are required to check their emails (inbox and other folders) for any communication from Madame Mak Jewellery (the Podia site). This is particularly important after purchasing your course/s, as this will contain your login credentials/student portal. If you are unable to find this email, please check your junk box and other folders first. If you are still unable to find the email, please contact Madame Mak at your earliest convenience for rectification.

19. By purchasing the course/s, you (the student) agree you have already read and agree to the terms and conditions outlined in this full agreement.

Student Personal Safety

1. Students are fully responsible for assessing the safety of their workspace and surroundings, and are fully responsible for setting up their workspaces adequately and using common sense. Students are required to take suitable measures to protect their eyes, face, respiratory system, body and hair from any potential hazards at the bench/in their own studio during the coursework. Students must have access to adequate safety equipment, and must wear safety glasses as well as having long hair tied back when operating power tools and torches, plus access to a multitude of respirators suitable for the job at hand, as well as other safety gear and implementations as covered in the course. By purchasing a course, students agree to take due diligence to research safety and appropriate measures, which may involve consulting with a third party. 

2. Madame Mak is not legally responsible or liable for any personal injuries or accidents that a student acquires during engaging in any one of Madame Mak's online courses, or after course completion. By purchasing a class, students herein agree to take full responsibility for their own safety and health at their bench during the coursework, and inherently agree to conduct their own research regarding personal protective equipment before commencing the coursework in physicality. By purchasing the course/s, students accept all liability for their safety and herein waiver Madame Mak Jewellery of any such liability and risk. By purchasing the course, you inherently abide to watch the relevant safety modules prior to commencing any course work. 

3. Students agree to read and understand the manufacturer instructions for any recommended safety measure and personal protective equipment noted in the coursework. Madame Mak Wax Academy is not liable or responsible for any student's misuse of personal protective equipment or any illness, injury or death as a consequence of improper use.

4. By purchasing the course/s, you (the student) inherently agree you will engage in watching the relevant safety module/s for each course purchased prior to commencing the course work in physicality.

Data Protection, Confidentiality and Permissions

1. At the time of checkout, Madame Mak Wax Academy collects your personal details via the host platform (your name, email address and address) to grant you access to your purchased course/s and for business records/tax reporting purposes. Madame Mak Wax Academy takes all reasonable effort to store your data securely. The host platform offers encrypted secure storage, however, by transacting on the internet you agree there is potential inherent risk of data breach via the host platform and will not hold Madame Mak Wax Academy responsible for any such breaches.

2. Your personal information provided at the checkout is strictly not shared with any third party.

3. By providing your details and subscribing/purchasing any courses via this platform, you agree for Madame Mak Wax Academy to contact you via any one of your listed contact details in the event it is required to maintain your subscription, or rectify any issues with the platform or your access.

4. Enrolled students acknowledge that their name (first name or full name) may be visible to other students in the discussion threads and comment sections of the course. This is by default and can not be changed. The visibility of a student's name is limited to other members of the same course or the same community.

5. By purchasing and engaging in a course, students may submit or post written or visual material to the site (eg. discussion threads and/or comment threads) to share progress with other members or to seek clarification from Madame Mak Wax Academy. You herein consent to visibility across the site, and for MMWA to share your name, words, voice, work and images for promotional and business development and marketing purposes without any compensation to the student. You acknowledge your submitted content may feature across the site and across all social media platforms. MMWA will make reasonable effort to seek your permission in advance to post your content to social media platforms where practical.

Intellectual Property and Accuracy of Delivered Content

1. Madame Mak teaches through the experiences and lessons she has gained whilst being at her bench (8+ years experience). All online courses are hosted via the Podia learning platform and the courses are not formally recognised or accredited by any relevant jewellery associations or training organisations. Students will not receive a certificate of completion or industry-recognised formal qualification.

2. Madame Mak does not accept responsibility for the consequences of, or any reliance that any person may place on any course material, course, or information supplied by the Academy.

3. Madame Mak teaches to the best of her ability and only teaches what she is absolutely confident, capable and comfortable with based on her years at the bench (and making hundreds of jewellery pieces). Madame Mak will refer you to another training organisation in the event you require further or more advanced (or certified) training.

4. Madame Mak makes no guarantee and will not be responsible or liable for the outcome of your wax work, castings or gemstone settings the student has created as part of the course/s and thereafter. All information provided in the online classes is based on Madame Mak's best advice, and it is advice only. Students are encouraged to find a method that works best for them. All members of the jewellery industry do things differently, and there are multiple ways to reach the same outcome. Alternatively, students may enrol in an industry-recognised course to attain formal training, qualification and certification. Madame Mak is backed by eight intense years at her bench and is very well placed to teach her courses through her own trials and tribulations.

5. Madame Mak cannot guarantee you will obtain a specific result via your engagement with the courses and coursework, and offers no guarantee that the course/s will result in employment opportunities or add weight to any such application.

E-Books and Learning Materials

1. All written and distributed learning material and instructions are copyrighted and belong to Madame Mak Wax Academy. Students must not copy, circulate or distribute any learning materials from the course which includes but isn't limited to e-books, PDF documents, illustrations, images contained within documents or any body of text or any written instructions and protocols or any videos to other parties.

2. Students must not disseminate (physically or electronically) any of the online learning material, including their login and password to other people. Shall a student be found in breach of this condition, Madame Mak reserves the right to terminate their course access early without warning.

3. Students acknowledge that Madame Mak has the right to make changes to any of the learning materials (removal of or addition to) without notice.

Accessibility

1. Madame Mak Jewellery endeavours to make all content accessible to members. All PDF documents contain alternative text on images, and all videos contain closed captions in English only. Shall you experience any difficulty accessing or viewing the materials, please contact Madame Mak Wax Academy for discussion and resolution. 

2. The courses at Madame Mak Jewellery are filmed and delivered in English. Captions are in a closed caption format (toggle on/off) and are accessible in English only. Madame Mak will not be uploading captions/translations in other languages. 

3. Captions are formatted in high contrast (black background with white text). Caption format cannot be changed, as they are natively inbuilt into the host platform (Podia).

External Web Links, Third Party Services and Listed Contacts

1. Madame Mak's content (PDF's and manuals) contain links to products, other platforms, stores/vendors and other industry members. Students acknowledge that these links may expire at any time during the coursework, and that Madame Mak will not be monitoring or updating any provided links. Links are provided to you for your convenience, however it is the students responsibility to search the appropriate keywords to find the relevant products and information if any given link has expired.  

2. Madame Mak Jewellery is not responsible or held liable for any outcome of any relationship a student initiates with any listed or linked third party contacts in the course material or Directories (eg. gemstone merchants/facetors, tool shops and other jewellery schools). Students shop at their own risk.

3. Madame Mak Wax Academy is not responsible or held liable for any data breaches, malware or virus acquisition affecting a user via their engagement with any link to a third party which may have been provided as part of the coursework. Students herein agree to access any external links provided within the coursework at their own risk.

4. Students acknowledge that the cost of goods (eg. tools and consumables plus estimated metal costs) is subject to change and varies in different geographical locations, and any budget estimates provided in the documentation and class information or videos were approximate at the time the course was filmed (2025, in AUD/Australian Dollars).

Host Platform Migrations

1. In the event of the website host (Podia) announcing closure of the Podia platform, Madame Mak Wax Academy will endeavour to migrate all materials to a new host in a timely manner. Students acknowledge there may be downtime during the process of converting and transitioning all course files to a new server. Students are ineligible for a refund in such instance, but will be provided with the new website link and account access details as soon as possible, and may contact Dahna via email (with the email address they used to purchase their course/s) for any course-related technical assistance they require.

Cross-Platform Information and Previous Learning Packages

1. Students acknowledge and accept that some materials and techniques uploaded to this learning platform (Podia) and demonstrated in the course/s have been previously shared for free to other social platforms as either long form or short form videos, static posts or reels. Students are not entitled to a refund or partial compensation for any such information overlap across the multiple social media platforms utilised by Madame Mak Jewellery/Madame Mak Wax Academy.

2. Existing and new students acknowledge and accept that some of the course documents (PDF's) have previously been packaged and sold via an online sales channel in the form of electronic downloads or in-person courses or via live 1:1 Zoom courses. Shall any newly enrolled former students have also purchased the same document or service in the past, they are not entitled to a retrospective refund for any of the overlapping materials provided in this online course. 

3. Students acknowledge and accept that some learning materials or short segments of video featured in parts of this course may be shared to other platforms by the business for social media at any time. Madame Mak Wax Academy reserves the right to reuse content on other platforms at their discretion with no compensation to current students.

4. Students acknowledge and accept that if a course/s is coming to a cessation by the business, part of or all the content may be reused in the future on other platforms for free or as a paid package.

Force Majeure

Madame Mak Wax Academy shall not be liable to you for any breach of its obligations which may arise from any unexpected causes beyond reasonable control, including but not limited to downtime of the website's host or server, regional or global natural disasters, war or conflict, acts of God, pandemics, government regulations, government restrictions or any subsequent geo-blocking, as well as any unforeseen circumstances such as illness or death of the course creator or the course creator's immediate family.

Course Pricing and Course Availability

1. Course prices are subject to change at the discretion of Madame Mak Wax Academy without provision of notice. All prices are listed in AUD (Australian Dollars).

2. Any promotional sales or discounts offered on courses are valid for the select period of time specified and cannot be retrospectively reimbursed to existing students.

3. The Complete Jewellery Course (bundle of the two separate courses) is being offered at 10% off the sum of the individual courses (permanently).

4. Any courses which are currently being offered for prospective student enrolments via the learning website may be switched to limited sign up at any time (ie. a quota cap) or closed off (ie. no new sign ups) at the discretion of Madame Mak Wax Academy.

5. Courses or any content contained therein (videos and files) may be modified and repackaged at any time to create new courses or mini-courses for use on this platform or other platforms.
